Acceptance of Terms

By creating an account, accessing, or using GEMflush services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

Service Description

GEMflush provides a platform for knowledge graph engineering and Generative Engine Optimization (GEO) services. Our services include:

  • Analysis of business visibility in AI-powered search systems
  • Structured data extraction and entity enrichment
  • Publication of business entity data to public knowledge graph infrastructure
  • Monitoring and reporting on AI discoverability metrics

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice.

User Accounts and Registration

To use certain features of our services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subscription Terms and Billing

Subscription Plans

We offer various subscription plans with different features and usage limits. Subscription fees are billed in advance on a monthly or annual basis, as selected during signup.

Payment

Payment is processed through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge your payment method for all fees associated with your subscription.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us.

Refunds

Refund policies vary by subscription plan. Generally, refunds are not provided for partial billing periods, but we may consider refund requests on a case-by-case basis for extenuating circumstances.

Acceptable Use Policy

You agree not to:

  • Use our services for any illegal purpose or in violation of any laws
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our services
  • Use automated systems (bots, scrapers) to access our services without permission
  • Publish information about businesses without proper authorization or ownership
  • Violate intellectual property rights of others
  • Transmit any viruses, malware, or harmful code

Violation of this Acceptable Use Policy may result in immediate termination of your account and access to our services.

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by GEMflush or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any business information you submit to our platform. By submitting information, you grant us a license to use, process, and publish that information as necessary to provide our services, including publication to public knowledge graphs.

Once information is published to public knowledge graphs, it becomes part of the public domain and may be used by third parties in accordance with the terms of those knowledge graph platforms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMFLUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use our services
  • Any changes we make to our services or discontinuation of services
  • Unauthorized access to or alteration of your data
  • Third-party conduct or content on our platform

Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

You may terminate your account at any time by cancelling your subscription and requesting account deletion. Note that information already published to public knowledge graphs may remain accessible after account termination.

Dispute Resolution

Any disputes arising from or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
